Seasoned journalist Kwesi Pratt has stated that the Chief Justice’s decision that no prima facie case has been established in the petitions seeking the removal of the Electoral Commission leadership is final and cannot be appealed.
Speaking on Pan African TV monitored by MyNewsGh, Pratt said the ruling is lawful and binding under the Constitution.
“It’s lawful. You cannot challenge it on the basis of process or the law. It’s finished,” he said. “You cannot appeal against the decision of the Chief Justice. Matter is closed.”
According to him, once the Chief Justice determines that no prima facie case has been made under Article 146, the process ends unless fresh petitions are filed.
“There’s no provision for review. No provision for review by the Chief Justice himself or even by the bench,” he stated.
Pratt added that while the quality of the decision may be debated for academic or educational purposes, it cannot be contested legally.
“As far as the law is concerned, the Electoral Commissioner and her deputies cannot be removed,” he said.
He emphasised that the Constitution vests that authority in a single individual.
“Only one person out of a population of 35 million is clothed with the authority of deciding whether or not this case should go forward,” Pratt noted.
“We have to abide by the decision whether we like it or not. That is what the law says.”
