ECOWAS court dismisses all claims filed by former CJ Gertrude Torkornoo

Deputy Attorney-General and Minister for Justice, Justice Srem-Sai, has shared details of a ruling by the ECOWAS Community Court of Justice involving former Chief Justice Gertrude Torkornoo.

In a post, Srem-Sai said the court dismissed all seven claims filed by the former Chief Justice against the Republic of Ghana.

“The ECOWAS Community Court has, a while ago, dismissed all of the 7 claims which the former Chief Justice, Her Ladyship Justice Gertrude Torkornoo, brought against our beloved Republic,” he stated.

He added that the court also addressed her claim for damages.

“In respect of Her Ladyship’s claim for US$10 million damages, the Court held that ‘in light of the Court’s conclusions that Ghana has not violated any of the Applicant’s rights under the African Charter as alleged, the Court makes no decision on reparations,’” he quoted.

Srem-Sai further noted that the decision followed legal representation by state attorneys who defended the Republic in the proceedings.

The case stemmed from the former Chief Justice’s challenge to her removal from office, in which she argued that her rights under the African Charter on Human and Peoples’ Rights were violated.

According to earlier proceedings at the ECOWAS Court, the matter had gone through preliminary objections and procedural hearings before the final determination.
