Punish Akonta, Not Just Wontumi – Lawyer

Private legal practitioner Godlove Adjei Tenkorang has disagreed with the court’s decision in the Samreboi illegal mining case, arguing that the punishment should have been directed at the company involved rather than Chairman Bernard Antwi Boasiako, popularly known as Chairman Wontumi.

Speaking on Angel FM, Kumasi, Lawyer Tenkorang said the alleged offence was committed through the company and questioned why the company was not the primary focus of the punishment.

“It is the company that committed the crime, so why did they not punish the company but rather Chairman Wontumi?” he questioned.

According to him, the assessment used in determining the offence was questionable because there was no written agreement supporting the arrangement.

He further argued that an assessment conducted without a formal written agreement should not be considered valid evidence for imposing liability on the individual.

“An assessment without a written agreement is not a valid assessment,” he stated.

Lawyer Tenkorang maintained that accountability in such cases should focus on the actual legal entity responsible for the offence rather than placing the entire responsibility on an individual connected to the company.

He stressed that the enforcement of the law must be guided by fairness and proper legal procedure to maintain public confidence in the justice system.
