Policy Analyst, Senyo Hosi has noticed that the New Patriotic Party (NPP) does not trust the Judiciary.
He says the political party holds the view that the current government has a hold on the third arm of government hence the decision to sue over interpretation on the tenure for presidents eventhough it is clearly stated in the constitution.
“Legally, it is a disgrace, but politically, I understand them because there is a total mistrust. The only thing I read here is mistrust of our judicial system.
The NPP feels that if they don’t get inside the thing, the perceived influence infleuence they think that the ruling government has on the judiciary can be used to create a new story. That is what this whole thing is about.
But this whole thing from number one to number 5 is a waste of time,”he said on TV3’s Keypoints on Saturday October 31, 2026.
In a writ the opposition party is asking the court to clarify whether the constitutional limit of two presidential terms applies regardless of whether they are served consecutively or at different periods.
The NPP is seeking a declaration that, under Articles 58(2) and 66 of the 1992 Constitution, “a person shall not be elected more than two times to hold office as President.”
It is also asking the court to declare that a person elected President “shall not hold office for more than two terms with each term consisting of four years (making a total of eight years), whether the two terms are consecutive or non-consecutive.”
The suit names the Attorney-General as the defendant and seeks clarification on the eligibility of individuals who have previously held the presidency.
