This doesn’t add up – Frank Davies disputes OSP’s defense

The Chairman of the Constitutional and Legal Committee of the New Patriotic Party (NPP), Frank Davies, has strongly criticized the Office of the Special Prosecutor (OSP) over its handling of a recent case.

Speaking on Joy News’ Newsfile monitored by MyNewsGh, Davies described the explanations given by the OSP as contradictory and inconsistent, questioning the logic behind their approach.

He expressed disbelief at the manner in which the case was being defended, stating, “How can what he has said be a defense of what happened? If this is how he communicates, then, with all due respect, he is casting a very poor picture of the office.”

Davies argued that the OSP’s position was riddled with inconsistencies, making it difficult to grasp a clear and logical point. He further pointed out that when someone fails to appear in response to a summons, there are established procedures that must be followed.

“You have written a letter to someone. Indeed, when that letter was written, the person was out of the jurisdiction.

“The person, being mindful of this, gets his lawyers to respond. There is an exchange of correspondence between you and the lawyers of the person. Whether he is a person of interest or a suspect is neither here nor there. There is a line of communication.”

Davies also referenced the individual’s justification for not appearing immediately, stating that they had communicated their medical condition and the need to consult their doctors before making themselves available. However, he was baffled by the OSP’s stance on the issue of medical documentation.

“This man says that a letter from a medical officer is not a medical report. You ask him a pointed question—why didn’t they request a medical report if they were so minded?

“Why didn’t they request it? He said that’s not their business, and they are not interested.”

According to Davies, this response highlighted a lack of due process, making it seem like the OSP was simply attempting to evade proper legal protocols.

“This was just an attempt to evade, and therefore they had to make a decision,” he concluded.
