Why NDC can’t sack Jean Mensa – Ofosu Kwakye finally reveals

Felix Ofosu Kwakye has stated that the Electoral Commission (EC) Chairperson Jean Mensa cannot be removed from office unless there is evidence of misconduct or she reaches the mandatory retirement age.

The Government Spokesperson, in an appearance on the Point of View on Channel One TV monitored by MyNewsGH, emphasized that the law protects the EC Chair from arbitrary dismissal.

“The Electoral Commissioner has security of tenure. You cannot remove her until she reaches retirement age or there is stated misconduct,” he said.

He noted that President John Mahama has not received any evidence to justify initiating proceedings for her removal.

“As we speak, the President has not been given evidence of misconduct. If that happens, he will kick-start the process to investigate the complaint and take appropriate action. But on his own, he is not going to dismiss anybody simply because he did not appoint them,” he explained.

Ofosu Kwakye further stressed that the President has no history of dismissing individuals in institutions where the law clearly regulates appointments and removals.

“He does not have a history of doing that, especially in cases where legal provisions govern how a person can be appointed or removed,” he stated.
